The Minister of Environmental Affairs has published her intention to declare small-scale char plants and small-scale charcoal plants as controlled emitters in terms of section 23(1) read with section 24 of the National Environmental Management Air Quality Act 39 of 2004 ("NEM:AQA").
The Notice differentiates between 'new plants' (i.e. any plant or process where an application for authorization in terms of the National Environmental Management Act 107 of 1998 ("NEMA") was made on or after 1 April 2010) and 'existing plants' (i.e. any plant or process which was legally authorised to operate before 1 April 2010 or where an application for authorization in terms of the NEMA was made before 1 April 2010) and makes provision for different compliance timeframes, pertaining to the emission limits as set out in the Notice, for new and existing plants respectively.
Members of the public are invited to submit written representations within 30 days from publication of this Notice (i.e. on or before 4 May 2015).
